An uncontested divorce is a type of divorce where both spouses agree to dissolve their marriage amicably; they agree on all major aspects of the divorce, such as property splits, support payments, and custody if children are involved. An uncontested divorce is generally much faster and can be completed for far less expense than a contested divorce. An unconstested divorce is perfect for spouses that are in agreement, want to save substantial money on legal fees, and want to avoid a long drawn out and emotional process.

The parties will be expected to have come to a mutual agreement on all important issues of their marriage. Issues such as property division, child custody and parenting time, child support, alimony or spousal support, and debt division. The Complaint is the document that is filed to commence the divorce case. This document tells the court what you are requesting and also provides the necessary statutory information that is required.
Even though you and your spouse have reached an agreement the divorce papers need to be properly served on the non-filing spouse and proof of this service filed with the court.
The non-filing spouse needs to make the decision on how and if they will file a formal response to the Complaint with the court. Their response would be in an answer form that responds directly to what the Complaint alleges. The non-filing spouse may also decide if a counter suit is necessary. If both parties have reached an agreement and the necessary final paperwork is being prepared the non-filing spouse may elect not to respond.
Nebraska has a statutory 60 day waiting period before a final divorce decree can be signed by a judge and entered with the court. This 60 day waiting period begins from the date that service is perfected.
Once the final paperwork has been prepared, reviewed and approved, and the 60 day waiting period has passed the case can be submitted to the court for final review and signature. If the parties agree and elect to sign a waiver of hearing it is quite possible that with our uncontested divorce package neither party needs to appear in court before a judge. However, the court does have discretion and may, in some cases, require a personal appearance of the parties. Once the judge signs the final decree, and attendant documents, and it is entered with the Court Clerk, your divorce will be considered final 30 days from the entry date.
